TERMS OF SERVICE

These Terms of Service ("Terms") govern your access to and use of the game
server hosting, billing, and related services (the "Service") provided by
VoidHosts ("we", "us", or "our"). By creating an account, purchasing a
service, or otherwise using VoidHosts, you agree to be bound by these Terms
and by our Fair Usage Policy set out below. If you do not agree, do not use
the Service.
1. ELIGIBILITY & ACCOUNTS
You must be at least 18 years old, or the age of legal majority in your
jurisdiction, to purchase or hold an account with us. If you are under that
age, a parent or legal guardian must hold the account and accept these Terms
on your behalf.
You are responsible for maintaining the confidentiality of your account
credentials and for all activity that occurs under your account, including
activity by anyone you grant subuser access to. Notify us immediately at
admin@mhsystems.ca if you suspect unauthorized access.
2. THE SERVICE
VoidHosts provides access to game server hosting resources (including but
not limited to CPU, memory, disk, and network allocations as described on
your order) delivered through our panel, along with associated billing and
support services. Specifications, features, and pricing for each plan are
as described on our website at the time of purchase and may change for
future billing periods with notice as described in Section 12.
3. BILLING, PAYMENT & REFUNDS
- Services are billed in advance on a recurring basis (monthly, quarterly,
or annually, as selected at checkout) unless otherwise stated.
- Failure to pay by the due date may result in automatic suspension of the
affected service. Repeated non-payment may result in termination and
deletion of the service and its data.
- Refunds, where offered, are subject to our refund policy: [describe
refund window, e.g. "a full refund is available within 48 hours of
initial purchase for a first-time order on a given service, excluding
domain registrations, custom/setup fees, and any service that has
already incurred verifiable usage or abuse"]. Refunds are issued to the
original payment method where technically possible.
- Chargebacks filed without first contacting our support team to resolve a
billing dispute are treated as a breach of these Terms and may result in
immediate suspension of all services on the associated account pending
resolution.
- All fees are exclusive of applicable taxes unless stated otherwise; you
are responsible for any taxes applicable to your purchase.
4. FAIR USAGE POLICY
Every plan includes a specific allocation of CPU, memory, disk, and network
resources. Those allocations are sized for the intended use of the service
you purchased (for example, running the game server software for the
player counts and modpack/plugin set typical of that plan). This Fair
Usage Policy exists to keep that allocation available for its intended
purpose and to keep resources fairly distributed across all customers
sharing the same physical node.
You agree not to, and not to permit any user of your service to:
- Sustain resource usage (CPU, RAM, disk I/O, or bandwidth) that is
disproportionate to your plan's intended use for extended periods, in a
way that degrades service for other customers on the same node.
- Run cryptocurrency mining software, mining pool connections, or any
process whose primary purpose is to generate cryptocurrency, whether
directly, through a plugin/mod, or through a downloaded/dropped
secondary process. This applies regardless of whether the plan's
allocated resources are technically sufficient to run it -- mining is
prohibited outright, not just when it exceeds your allocation.
- Use the service as general-purpose file, media, or backup storage
unrelated to the operation of the game server itself (e.g. as a personal
cloud drive, media streaming server, or torrent seedbox).
- Run background processes, bots, schedulers, or automation unrelated to
the hosted game server's operation.
- Attempt to circumvent resource limits, container isolation, or panel
restrictions (including privilege escalation, container breakout
attempts, or modifying panel/daemon software you were not given explicit
access to modify).
We monitor aggregate and per-service resource usage to detect abuse. Where
we identify usage inconsistent with this policy, we may, at our discretion
and depending on severity: contact you for clarification, throttle the
affected service, suspend the service pending review, or terminate the
service without refund for severe or repeated violations (including any
cryptomining, regardless of first offense).
5. ACCEPTABLE USE POLICY
You agree not to use the Service to:
- Host, transmit, or distribute content that is illegal under the laws of
Canada or the Province of Alberta, or in the jurisdiction the content is
served to, including child sexual abuse material, which will be reported
to the relevant authorities and result in immediate termination without
refund.
- Infringe the intellectual property rights of any third party, including
distributing pirated software, cracked plugins/mods, or copyrighted
material you do not have the right to distribute.
- Send unsolicited bulk communications (spam), conduct phishing, or
otherwise misrepresent your identity to deceive others.
- Launch or participate in denial-of-service attacks, port scanning,
network intrusion attempts, or any activity intended to disrupt or gain
unauthorized access to systems you do not own or have explicit
permission to test.
- Distribute malware, exploits, or any code designed to damage, disable,
or gain unauthorized access to computer systems.
- Violate the terms of service, EULA, or usage policies of any game or
software you run on the Service (for example, Mojang's Minecraft EULA,
where applicable), including operating a pay-to-win monetization model
prohibited by the relevant publisher.
- Resell or sublicense the Service without our prior written
authorization.
Violation of this Acceptable Use Policy may result in suspension or
termination of the affected service, and in the case of illegal content or
activity, may be reported to law enforcement.
6. SERVICE AVAILABILITY
We work to keep the Service available and performant but do not guarantee
uninterrupted or error-free operation. Scheduled maintenance will be
announced in advance where reasonably possible. [If you offer an uptime
SLA with service credits, describe it here; otherwise state plainly that
no uptime guarantee is offered outside of any specific plan that says
otherwise.]
7. BACKUPS & DATA
[Describe your actual backup policy here -- e.g. whether automatic backups
are taken, how often, how many are retained, and whether customers are
expected to maintain their own backups.] You are responsible for
maintaining your own backups of any data you consider critical. We are not
liable for data loss resulting from hardware failure, service suspension
or termination, customer error, or events outside our reasonable control.
8. SUSPENSION & TERMINATION
We may suspend or terminate your access to the Service, with or without
notice, for: non-payment, violation of these Terms (including the Fair
Usage Policy and Acceptable Use Policy), fraudulent chargebacks, abuse
directed at our staff or infrastructure, or where required by law.
Upon termination for cause, no refund is owed for the remaining service
period. Following termination, associated data may be deleted after
[retention period, e.g. "7 days"], after which it is not recoverable.
You may cancel your service at any time through your account. Unless
otherwise stated in Section 3, cancellation does not entitle you to a
refund of any period already paid for.
9. DISCLAIMER OF WARRANTIES
The Service is provided "as is" and "as available" without warranties of
any kind, whether express or implied, including but not limited to
implied warranties of merchantability, fitness for a particular purpose,
and non-infringement, to the fullest extent permitted by applicable law.
10. LIMITATION OF LIABILITY
To the fullest extent permitted by law, VoidHosts and its owners,
employees, and affiliates will not be liable for any indirect, incidental,
special, consequential, or punitive damages, or any loss of profits, data,
or goodwill, arising out of or related to your use of the Service, even if
advised of the possibility of such damages. Our total liability for any
claim arising from the Service is limited to the amount you paid us for
the affected service in the [three (3)] months preceding the claim.
11. INDEMNIFICATION
You agree to indemnify and hold harmless VoidHosts and its owners,
employees, and affiliates from any claim, liability, damages, or expenses
(including reasonable legal fees) arising from your use of the Service,
your content, or your violation of these Terms.
12. CHANGES TO THESE TERMS
We may update these Terms from time to time. Material changes will be
posted on this page with an updated "Last updated" date, and where
practical we will notify active customers by email at least [14 days]
before the change takes effect. Continued use of the Service after a
change takes effect constitutes acceptance of the revised Terms.
13. GOVERNING LAW
These Terms are governed by the laws of the Province of Alberta and the
federal laws of Canada applicable therein, without regard to conflict of
law principles. Any dispute arising from these Terms or the Service will
be resolved in the courts of Alberta, Canada, and you consent to that
jurisdiction.
14. SEVERABILITY
If any provision of these Terms is found unenforceable, the remaining
provisions will remain in full force and effect.
